Terms of Service
Effective July 10, 2026
If you can’t agree to those, please don’t use the service.
What MyChatIEP is
MyChatIEP is a software product that helps Florida parents and advocates navigate Individualized Education Programs (IEPs) and Section 504 plans. It uses large language models from OpenAI, Anthropic, and Google to:
- Answer questions about IDEA, Section 504, and Florida special-education rules.
- Help you prepare for IEP and 504 meetings.
- Draft letters, requests, and follow-ups.
- Summarize meetings and review Prior Written Notices.
What MyChatIEP is NOT
MyChatIEP is not a law firm. We do not provide legal advice. Nothing the AI generates is a substitute for advice from a licensed attorney. If your situation involves litigation, due process, complaints to the Florida Department of Education, or any matter where the stakes warrant counsel, please consult an attorney.
We are also not a medical, psychological, or educational diagnostic service. The app does not diagnose, treat, or evaluate any condition.
Who can use MyChatIEP
You may use MyChatIEP only if:
- You are at least 18 years old.
- You are the parent, legal guardian, or authorized advocate of the child whose case you create.
- You agree to these Terms and our Privacy Policy.
The service is currently focused on residents of Florida. If you sign up from outside Florida, you may use the app, but the legal information surfaced in the app is Florida-specific and may not apply to your jurisdiction.
Your account
You are responsible for:
- Keeping your password secure (or your Google account secure if you sign in via OAuth).
- Everything that happens under your account.
- Notifying us immediately if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms.
Subscriptions and billing
We offer three tiers:
- Free: limited daily chat, no document downloads.
- Family: expanded daily chat, monthly letter generation, meeting prep.
- Advocate: higher quotas for professional users.
Current pricing and limits are listed on the homepage. We may change pricing with 30 days’ notice to existing subscribers.
Billing
Paid plans are billed monthly in advance via Stripe. Charges renew automatically until you cancel. You can cancel anytime from Settings → Manage subscription; cancellation takes effect at the end of your current billing period.
Refunds
We don’t offer pro-rated refunds for partial months. If you believe you’ve been charged in error, email hello@mychatiep.com and we’ll review it.
Failed payments
If a charge fails, we’ll retry per Stripe’s standard logic. If payment cannot be collected after retries, your account reverts to the Free tier; your case data is preserved.
Acceptable use
You agree NOT to:
- Submit content that is illegal, defamatory, or infringes someone else’s rights.
- Use the service to harass, threaten, or impersonate anyone.
- Attempt to extract our system prompts, AI provider credentials, or internal tooling.
- Reverse-engineer the service or scrape it at scale.
- Resell access to your account.
- Use the service to provide legal advice to others. The service is for your own family / cases, or for an advocate’s authorized representation.
Your content
You retain all rights to the case data, documents, and chat content you put into MyChatIEP. We have a limited license to host, display, and process that content solely to provide the service to you. We do not use your content to train any AI model.
Our service
The MyChatIEP software, design, copy, prompts, and brand are owned by MyChatIEP or its licensors. You may not copy, modify, or distribute them.
AI-generated content
You understand that the AI assistant generates probabilistic responses. They may be:
- Out of date as laws and regulations change.
- Wrong about specific facts in your case.
- Inconsistent across sessions.
Always review AI-generated letters and information before relying on them. You are responsible for any content you send to a school, district, or other party, even if you used MyChatIEP to draft it.
No warranty
The service is provided “as is” and “as available.” To the maximum extent permitted by Florida law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, MyChatIEP and its principals will not be liable for any indirect, consequential, or punitive damages arising out of your use of the service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months before the claim arose. If you’re on the Free tier, that means $0.
Indemnification
You agree to defend and indemnify MyChatIEP from any claim arising out of (a) content you submit to the service, (b) your violation of these Terms, or (c) your use of AI-generated content with third parties.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to jurisdiction there.
Termination
You may delete your account anytime from Settings → Delete Account. We may suspend or terminate accounts that violate these Terms with notice (or immediately for severe violations).
If you delete your account, it enters a 30-day pending-deletion window during which you can restore it; after that window your case data is permanently purged, as described in the Privacy Policy.
Changes
We may update these Terms. Material changes will be announced by email at least 14 days before they take effect. Continued use after that date means you accept the new Terms.
